1. Acceptance of Terms
By creating an account or using SalesPilot AI, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms on behalf of yourself or your organization, and agree to comply with all applicable laws.
2. Description of Service
SalesPilot AI provides an AI-powered WhatsApp CRM platform that enables businesses to manage customer conversations via the WhatsApp Business API, automate replies, manage leads, send broadcast messages, and access analytics. The service is provided on a subscription basis.
3. WhatsApp Business API Compliance
Your use of SalesPilot AI is subject to Meta's WhatsApp Business API Terms and Policies. You agree to:
- Only send messages to users who have opted in to receive communications from your business
- Not use the platform for spam, phishing, or any abusive messaging
- Comply with all applicable laws, including data protection regulations
- Only use Meta-approved message templates for business-initiated conversations
- Promptly address any opt-out requests from customers
Violation of WhatsApp's policies may result in your WhatsApp Business Account being suspended or permanently banned by Meta, for which SalesPilot AI bears no liability.
4. Account Registration
You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access to your account.
5. Subscription and Payment
SalesPilot AI offers subscription plans as described on our pricing page. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.
6. Acceptable Use
You agree not to use SalesPilot AI to:
- Send unsolicited, deceptive, or illegal messages
- Harass, threaten, or discriminate against any person
- Transmit malware, viruses, or harmful code
- Infringe on intellectual property rights of others
- Attempt to reverse engineer or circumvent our platform's security
- Resell our services without prior written authorization
- Violate any applicable local, state, national, or international law
7. Intellectual Property
SalesPilot AI and its original content, features, and functionality are owned by SalesPilot AI and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works of our platform without prior written consent. You retain all rights to your own data and content.
8. Data and Privacy
Your use of SalesPilot AI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for obtaining all necessary consents from your customers before collecting or processing their data through our platform.
9. Limitation of Liability
To the maximum extent permitted by law, SalesPilot AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use or inability to use our services. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.
10. Disclaimer of Warranties
SalesPilot AI is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. We are not responsible for any interruptions caused by WhatsApp, Meta, or other third-party services.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment of fees, or misuse of the platform. You may cancel your subscription at any time through your account settings. Upon termination, your right to access the platform ceases immediately.
12. Governing Law
These Terms shall be governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
13. Changes to Terms
We may update these Terms periodically. We will notify you of significant changes via email or a prominent notice on our platform. Continued use of the service after changes constitutes acceptance of the revised Terms.
